Creditors’ Rights

WHAT IS CREDITORS' RIGHTS LAW?

The practice of creditors' rights focuses on a particular aspect of contract law - the recovery of money from individuals or businesses who have failed to timely meet their financial obligations. We are able to enforce contracts against individuals who reside in Massachusetts and Rhode Island.

Our practice is more than simply attempting to collect debts which are owed. We assist our clients in developing contract language designed to limit areas of potential dispute which can result in a customer erroneously believing that there is a "legal" way to avoid payment.

With regard to collection portfolios, we work with our clients to develop a recovery program which is consistent with their objectives and resources. In doing so, we evaluate each claim's potential for recovery based upon not only the legal analysis, but common sense factors which tend to suggest the borrower's likely short and long term ability to pay.
